POLICY

A. Purpose

A Berkeley Lab employee will be granted necessary time off with pay, not to exceed two hours, for voting in any statewide primary or general election if the employee is scheduled to work eight hours or more on that day and does not have time to vote outside working hoursLawrence Berkeley National Laboratory (Berkeley Lab) supports employees' rights to fulfill their civic responsibilities by voting in elections. This policy describes Berkeley Lab's policy on voting leave.

B. Persons Affected

All employeesThis policy applies to non-represented employees in all employee classifications. Represented employees should consult their collective bargaining agreement (CBA).

C. Exceptions

Not applicable. Requests for exceptions that exceed what is allowed under current policy or that are not expressly addressed by current policy are considered exceptions to policy. A request for an exception to policy requires, at a minimum, the approval by of the Chief Human Resources Officer (CHRO).

D. Policy Statement

An employee will be granted necessary time off with pay, not to exceed two hours, for voting in any statewide primary or general election if the employee is scheduled to work eight hours or more on that day and does not have time to vote outside working hours.

  1. A non-exempt employee may take up to two (2) hours of paid leave at the beginning or end of a workday to vote in local, state, or national general elections or primaries. Any additional time off that is taken for this purpose is without pay.
    1. To be eligible, an employee must be scheduled to work at least eight (8) hours that day and not have enough time to vote outside of the employee's normal working hours.
    2. Voting leave is not considered time worked for purposes of computing overtime pay for non-exempt employees.
  2. An exempt employee may take up to two (2) hours at the beginning or end of a workday to vote. Leave status will not be required for exempt employees.
  3. Employees who know or have reason to believe that time off to vote will be necessary must inform their supervisors as soon as possible and no later than two (2) working days before Election Day.

Managers, supervisors, and employees have the responsibility to adhere to the provisions of this policy.
