    Policy Summary

    The capture and use of photography, video, and audio recording is a routine part of research and operations at Berkeley Lab. Use of such information must be in direct support of the mission of Berkeley Lab and not violate privacy rights of individuals or conflict with applicable state and federal laws.

    All persons with an assignment to Berkeley Lab to include employees, affiliates, rehired retirees, contractors, subcontractors, consultants, undergraduate and graduate students, postdoctoral fellows, and faculty. Hosts of those accessing and/or visiting LBNL facilities are responsible for ensuring adherence to this policy.

    POLICY

    A. Purpose

    This policy provides policy guidance on the use of photography, video, and audio recording equipment at LBNL. LBNL routinely uses such equipment in support of Berkeley Lab research and operations. 

    B. Persons Affected

    This policy applies to all persons with an assignment to Berkeley Lab to include employees, affiliates, rehired retirees, contractors, subcontractors, consultants, undergraduate and graduate students, postdoctoral fellows, and faculty. Hosts of those accessing and/or visiting LBNL facilities are responsible for ensuring adherence to this policy.

    C. Exceptions

    None.

    D. Policy Statement

    1. All persons who enter LBNL managed property, to include owned or leased facilities, may be subject to video and audio monitoring and recording as part of LBNL’s safety and security programs.
    2. The procurement, installation and use of camera, video, and audio recording equipment, systems and devices that is not used in connection with LBNL safety and security programs is not permitted unless it is strictly for official purposes related to the mission of the organization and approved by appropriate line management. No special institutional approval is required to procure, install, or use such equipment, systems, or devices, however their use must be in strict adherence to this and other applicable policies
    3. The use of Unmanned Aerial Systems (“UAS”) (also referred to as drones), over LBNL owned or leased property is generally prohibited and must be in accordance with the LBNL Aviation Management and Safety policy. The capture and use of any data obtained in conjunction with UAS flights is prohibited unless for an approved activity. LBNL has the right to restrict the use and dissemination of any data obtained on LBNL property by UAS.
    4. The use of any information obtained by camera, video, or audio recording equipment, or any device that may record personal information to include personally owned devices such as smartphones, shall be in strict adherence to privacy laws and not conflict with any applicable state or federal statutes, or policies of the Department of Energy, and be in compliance with the following principles and policies: 
      1. Ethics and Conduct at Berkeley Lab

      3. Berkeley Lab Privacy Policy
    5. Approval of the Laboratory Counsel is required to install concealed cameras and recording devices when necessary to detect and/or provide evidence of theft, fraud, or misconduct on Laboratory-owned, -leased, or -controlled property or facilities.
    6. Requests for information obtained by video and audio recording data associated with the Laboratory’s physical security systems must be made to the Security and Emergency Services Division in writing and be approved by Laboratory Counsel.

    • Approve any requests for the installation and monitoring of concealed audio and video equipment for investigative purposes.
    • Approve requests for information obtained by video and audio recording data associated with the Laboratory’s physical security systems.

    Security and Emergency Services Division

    • Safeguard audio and video recording data related to Physical Security Systems and ensure it is used only for official purposes.
    • Respond to requests for audio and video data and coordinate approval through the Office of Laboratory Counsel.
