BRIEF
Policy Summary
Photography, video, and audio recording at Berkeley Lab is used extensively to accomplish Berkeley Lab's scientific mission and work. Protective Services manages and authorizes institutional and investigative recordings and device installations. Berkeley Lab will balance the privacy rights of individuals accessing Berkeley Lab-owned, -leased, or -controlled property with its own rights and needs for such recordings.

POLICY
A. Purpose
This policy provides guidance on the installation and use of still and video cameras and audio recording devices.
B. Persons Affected
This policy applies to all persons, including visitors, employees, affiliates, rehired retirees, contractors, subcontractors, consultants, undergraduate and graduate students, postdoctoral fellows, and faculty, who enter Berkeley Lab-owned, -leased, or -controlled properties or facilities.
C. Exceptions
The following exceptions are exempt from this policy:
- Law enforcement investigations authorized through valid legal processes
- Audio and video streaming and recording devices built into computers and/or cellular phones used in and for office-related purposes
D. Policy Statement
- The use of cameras, audio, and/or video recording or streaming devices must be used in full compliance with all applicable state and federal laws.
- For security, identification, investigation, safety, fire detection, emergency management, traffic management, and/or wildlife management purposes, Protective Services operates fixed and portable camera systems that record activity. Berkeley Lab property is posted with signs notifying all persons that their activity may be subject to surveillance monitoring and recording.
- No person may install a camera or recording device nor use such a device to monitor people or property or to record or video stream on Laboratory-owned, -leased, or -controlled property or facilities for any of the purposes listed above in Section D.2 of this policy without the written approval of Protective Services.
- Protective Services must request the approval of the Laboratory Counsel or the Chief Operating Officer to install concealed cameras and recording devices when necessary to detect and/or provide evidence of theft, fraud, or misconduct on Laboratory-owned, -leased, or -controlled property or facilities.
- Protective Services, with approval by the Laboratory Counsel and/or the Chief Operating Officer, may post certain areas of the Laboratory as "No Recording" areas. In those areas, all photography and video/audio recording or streaming is prohibited.
- All uses other than those described above must be in compliance with the following principles and policies:
