Background

In August 2022, DOE Order 471.7 was incorporated into Berkeley Lab's Prime Contract, requiring the Lab to establish a Controlled Unclassified Information (CUI) Program and document a policy for designating and handling information that qualifies as CUI. Based on this contract modification, a three year implementation plan was developed.

While Berkeley Lab is working towards attaining full compliance with this order by August 2025, Federal Government agencies have started to mark information and documents as CUI. There is now an immediate need for an interim solution that allows Berkeley Lab employees to receive and store files marked CUI. There should be no marking of material as CUI by Lab employees at this time. 

To that end, the IT Policy group reviewed NIST SP 800-171 Rev. 2, Protecting Controlled Unclassified Information in Nonfederal Systems and Organizations, and has implemented an interim solution, inline with 800-171 requirements. The interim solution is available to those Lab employees that either are receiving or anticipate receiving information marked as CUI in their inbox, or have a need to store CUI in a Google shared drive. 

What to do if you have an immediate need to receive or store CUI?

What if you receive CUI but do not have a CUI-Enabled account?

If you receive CUI and you do not have a CUI-enabled account, you must immediately:

  • Delete the email and empty your email trash
  • If you downloaded the file, delete the file and empty trash as well
  • If colleagues were copied on the email, they must also take the above actions
  • Email [email protected] and let them know that you received CUI and detail the steps you took

What to do if you have an immediate need to send CUI?

The options to send CUI are less developed at this time, they include:

  • to someone inside the Lab, use a CUI enabled Shared drive
  • to someone outside the Lab, contact [email protected] and we'll advise on a solution
  • to someone outside the Lab insisting you use Entrust, contact [email protected]
