POLICY
A. Purpose
This policy outlines the terms and conditions for Faculty appointments, a role designated exclusively for University of California (UC) faculty members.
For non-UC visiting faculty positions, see the Appointments, Limited policy.
For additional information on the hire, promotion, and termination due to lack of funding of faculty appointments, see the Appointments, Scientist & Engineer policy.
B. Persons Affected
This policy applies to all non-represented employees. Represented employees should consult their collective bargaining agreement (CBA).
C. Exceptions
Requests that exceed what is allowed under current policy, or that are not expressly addressed by current policy, are considered exceptions to policy. A request for an exception to policy requires, at a minimum, the approval of the Chief Human Resources Officer.
D. Policy Statement
- General. The Faculty appointment is a Scientist and Engineer (S&E) position reserved for individuals in University of California (UC) faculty appointments, in accordance with the UC Academic Personnel Manual (APM). The Faculty appointment requires the individual to hold an active UC faculty appointment in one of the following faculty titles or series:
- Professorial series
- Acting titles in the Professor series (students who hold the Acting Instructor title are not considered faculty)
- Visiting titles in the Professor series
- Professor in Residence series
- Adjunct Professor series
- Professor of Clinical (e.g., Medicine) series
- Health Sciences Clinical Professor series
- Types of Faculty. Faculty appointments fall into one of the following categories:
- Regular Faculty. Regular faculty are paid by the faculty’s UC campus during the academic year and may receive a summer salary from Berkeley Lab if eligible.
- Shared Faculty. Shared faculty, governed by a Memorandum of Understanding (MOU) between Berkeley Lab and the faculty’s UC campus, will have a percentage of their academic year salary and benefits reimbursed to the campus by Berkeley Lab. Shared faculty may also be paid a summer salary by Berkeley Lab.
- Joint Faculty. Joint faculty are established through a collaborative recruitment process between Berkeley Lab and the faculty's UC campus. Joint faculty are governed by an MOU between Berkeley Lab and the UC campus that outlines the appointment details, with Berkeley Lab reimbursing the campus for 50% of the faculty member’s academic year salary and benefits. Joint faculty may also be paid a summer salary by Berkeley Lab if eligible.
- Applicability of Policy. The faculty appointment is subject to both the UC Academic Personnel Manual (APM) and applicable Berkeley Lab Requirements and Policy Manual (RPM) policies. Berkeley Lab will coordinate with the faculty appointee’s campus to ensure that the applicable policies and procedures are appropriately followed.
- Appointment
- In accordance with the Recruitment and Hiring policy, a competitive recruitment is not required for faculty appointments.
- However, for joint faculty, Berkeley Lab will collaborate with the applicable UC campus to recruit the position.
- Termination
- Termination of a faculty appointment is automatic upon termination of the individual's UC campus faculty appointment.
- Termination of a faculty appointment may be terminated at any time at the discretion of Berkeley Lab. At a minimum, 90 days’ written notice will be given.
- However, joint faculty will be given special consideration for termination due to lack of funding, including written notice 24 months prior to date of termination and written final confirmation of termination 90 days prior to termination.
