POLICY
A. Purpose
This policy defines the terms and conditions of a limited appointment.
B. Persons Affected
This policy applies to non-represented employees. Represented employees should consult their collective bargaining agreement (CBA).
C. Exceptions
Requests that exceed what is allowed under current policy or that are not expressly addressed by current policy are considered exceptions to policy. A request for an exception to policy requires, at a minimum, the approval of the Chief Human Resources Officer.
D. Policy Statement
General
- A limited appointment may be established at any percentage of time, fixed or variable, during which an appointee is expected to be on pay status for up to a maximum of 900 hours in a 12-month rolling period. By exception per Section C of this policy, a limited appointee may be on pay status up to 960 hours in a 12-month rolling period.
- Limited appointments are most appropriate for short-term work with an expected end date.
- In accordance with the Recruitment and Hiring policy, an open recruitment is not required for a limited appointment.
- Visiting Faculty. Visiting Faculty is a limited appointment for faculty members from universities and colleges outside the University of California system.
- Appointment. The division director makes appointments to a Visiting Faculty position.
- Salary. The salary for a Visiting Faculty is typically based upon the faculty salary rate at the home institution. An exception may be requested if the Visiting Faculty is on paid or unpaid leave from their home institution, or if their home institution salary is significantly lower than that of their peers at Berkeley Lab. In such cases, an exception can be sought either to align the salary with Berkeley Lab peers or to provide a supplemental payment that brings the compensation up to the level of Berkeley Lab peers.
- Rehired Retirees
- Rehired retirees are Berkeley Lab/University of California (UC) retirees hired into limited appointments in accordance with the following UC policy, procedures, and frequently asked questions:
- Rehired retirees are not allowed to supervise staff or serve as hosts for contract workers and affiliates.
- Rehired retirees are Berkeley Lab/University of California (UC) retirees hired into limited appointments in accordance with the following UC policy, procedures, and frequently asked questions:
- Conversion to Career
- A limited appointment will be designated as a career appointment when the appointee:
- Has attained 1,000 hours of qualifying service in a 12-month rolling period, and
- Has not had a break in service of at least 120 consecutive calendar days.
- However, divisions are expected to manage limited appointments so that this situation rarely occurs. In cases where there is a possibility that a limited appointment may continue beyond 1,000 hours in any 12-month rolling period, a competitive recruitment must be conducted to fill the appointment.
- The career appointment designation will be effective the first of the month following attainment of 1,000 hours of qualifying service. Qualifying service includes all time on pay status in one or more limited appointments within the University of California system. On-call and overtime hours will not be included as pay status hours when computing qualifying service.
- The probationary period for employees in limited appointments that convert to career appointments is covered in the Terms & Conditions of Employment policy.
- A limited appointment will be designated as a career appointment when the appointee:
- Termination of Appointment
- A limited appointment may be released at any time at the discretion of Berkeley Lab. However, Berkeley Lab must notify the appointee of an early release in writing.
- A limited appointment will automatically terminate on the last day of the appointment unless there is an earlier separation or formal extension of the appointment in writing.
E. Roles and Responsibilities
Managers, supervisors, and employees have the responsibility to adhere to the provisions of this policy.
